As a public function, the main public service mission of the notary is to authenticate deeds and contracts (sale, marriage, inheritance settlements, donation, etc.) on behalf of the State.
In addition, the notary is required to advise their clients in the preparation of documents by sharing their knowledge in the legal field. In recent years, the notary's activities in advising companies have become more and more frequent. Indeed, the notary will help the company creator in the drafting of its articles of association, its commercial lease or accompany a person in the purchase of a business. The notary operates in various fields, such as family law, real estate, heritage and company law. To assist him/her on a day-to-day basis, a notary can work with a clerk of notaries.
To become a notary and secure a job, you must hold a Master's degree, Bac+5 or LLM in law, then continue with a 2-year training course to obtain the Higher Notarial Diploma (DSN) or the Diploma of Aptitude for the Functions of Notary (DAFN). A notary may work in a notary's office as an employee or buy an office in order to work as a self-employed person.
In Luxembourg, the number of notaries is limited and is spread over all the cantons, depending on the population and the number of cases. Once a candidate has graduated, he or she is placed on a waiting list, although the waiting time varies between 5 and 10 years. In the meantime, the notary may work as a lawyer, jurist (notarial jurist, real estate jurist) or magistrate. Recruitment for the position of notary is therefore almost non-existent.
