The right to disconnect in Luxembourg

In an increasingly hyper-connected working world, maintaining a healthy boundary between professional and personal life can be challenging. That is why the right to disconnect has been introduced in Luxembourg. Its purpose is to prevent employers from requiring employees to work outside their statutory working hours.



What is the right to disconnect?


The right to disconnect was incorporated into Luxembourg's Labour Code in 2023. It applies to all employees working in the country and states that employers cannot require staff to respond to emails, phone calls or messages outside their normal working hours.


The right to disconnect for employees also places a duty on employers. According to the Luxembourg Chamber of Employees, every employer must:


  • Ensure that workloads and deadlines do not prevent employees from exercising their right to disconnect;
  • Regularly assess whether employees' workloads are reasonable and allow working time to be spread appropriately;
  • Ensure that no employee infringes upon the right to disconnect of their colleagues;
  • Use information and communication technologies (ICT) responsibly, while respecting employees and their private lives;
  • Ensure that employees comply with the minimum requirements for breaks, daily and weekly rest periods, and annual leave.



New penalties introduced


Since 4 July 2026, companies that fail to comply with the right to disconnect can face fines ranging from €251 to €25,000. Employees may report any breaches of this right where they believe their managers or employers have acted improperly.


This legislation helps promote a healthier work–life balance by preventing employees from being expected to work during their personal time. It is particularly relevant at a time when remote working has become increasingly common, helping to ensure that the boundary between work and home does not become blurred.
